Terms of Service

1. Scope of Services & Deliverables

By checking the agreement box during checkout, the Client engages Russell Moore Photography (the "Provider") to deliver the specific recruiting package selected at the time of purchase. Service tiers include:

• Profile Only: A custom, search-optimized landing page hosted at recruiting.russell-moore.com. Turnaround time is 14 days from receipt of all client data.
• Profile + Shoot: Includes the Profile package plus a 90-minute on-location athletic photography session.
• All-American: Includes all above services, upgraded to a 120-minute shoot, a short video hype clip, priority delivery, and two free Season Updates.

2. Fees, Payment, and On-Going Hosting

• Creative Fee: The initial payment submitted via the website checkout constitutes a 50% non-refundable retainer to lock in the shoot date and development schedule. The remaining 50% will be invoiced and due upon page completion before the URL goes live.
• Annual Maintenance Subscription: The initial purchase includes hosting and search indexing for one calendar year from the live date. To maintain the page, an annual Season Update subscription of $129/year will automatically bill starting one year from the live date.
• Cancellation: The Client may cancel the annual subscription at any time. Upon cancellation, the live page will be taken down at the end of the current billing cycle.

3. Image Rights & Usage

• Provider Rights: Russell Moore Photography retains the copyright to all images and media captured. The Provider reserves the right to use the imagery and the live landing page for promotional, marketing, and portfolio purposes.
• Client Usage: The Client and Athlete are granted an explicit, royalty-free, perpetual license to use the images, videos, and the direct webpage link for personal use, social media recruitment, college athletic applications, and sharing with scouting networks. Commercial resale of the imagery is strictly prohibited.

4. Technical Uptime & Data Ownership

• Uptime: The Provider utilizes industry-standard third-party hosting to ensure a target uptime of 99.9%. The Provider is not liable for temporary, unforeseen disruptions caused by third-party server outages.
• Data Ownership: The Client retains full ownership of all personal data, statistics, and biographical information. Upon formal request or service termination, the Provider will deliver a digital archive of all high-resolution imagery and compiled text assets to the Client within 30 days.

5. Shoot Logistics & Postponements

If a photography session must be postponed due to severe weather, athletic scheduling changes, or athlete injury, the Client must notify the Provider at least 24 hours in advance. The session will be rescheduled to a mutually agreeable date at no additional cost.
